In these Terms and Conditions the following terms have the following meanings :

Accomodation means the apartment shown in the confirmation invoice or as may otherwise be agreed in writing between the Val Lachard and the Renter,

Agreement means the agreement between the Val Lachard and the Renter for the holiday rental of Accomodation on there Terms and Conditions,

The Val Lachard means (The Val Lachard, chemin des Prés, 38250 Villard de Lans) and

Renter : means the person named in the confirmation invoice.

 

1.  Agreement

These Terms and Conditions are printed on our website and with the confirmation invoice. The making of a booking will form an agreement on these  Terms and Conditions between the Renter and Le Val Lachard for the holiday rental of the Accomodation.

The Val Lachard permits the Renter to occupy the Accomodation for the holiday period shown in the confirmation invoice together with the use of its contents.

 

2.  Information

Our website ( www.vallachard.com) gives all information on prices, dates and details concerning location and characteristics of the apartments. Information given on web site are valid at the time of booking.

 

3.  Booking and Payment Terms

1. The total price for your booking (the "rental price") and the dates on which the rental price is payable, will be set out in your confirmation invoice.

2. Bookings can be made online, by email, post or telephone.

For bookings made 90 days before the rental, the booking will be effective when a deposit of at least 30% of the accomodation price has been received by Le Val Lachard.

For bookings made 60 days before the rental, the booking will be effective when a deposit of at least 60% of the accomodation price has been received by The Val Lachard.

The full balance of the total accomodation price will be payable not later than 30 days before the rental begins.

3. For bookings made for a holiday less than 30 days in advance, full payment must be made at the time of booking.

4. The rental price are in euros, include Value Added Tax ("VAT") and cover the apartment rental. They do not include local taxes and optional services.

5. Prices are for the period confirmed and the maximum capacity allowed in the apartment include adults, children and babies. The occupation limits are set in line with the Insurance Policy.

6. Are to be paid on your arrival :

a.  Local taxes (0.83 euro per person and per night)

b.  Refundable damage deposit covering 50% of the rental amount, with a minimum of 700 euros when keys are given. The cost of any damage or breakages will be deducted from the deposit and the remainder refunded to you in full within 60 days of the end of your stay.

7. Most rentals can be booked and paid through our website on which you have access to secure website of Caisse d'Epargne.

8. Booking Confirmation

Upon receipt of the deposit, we confirm the rental, either by email or post.

 

4. Cancellation

1. made by the Renter

Le Val Lachard cannot be held responsible for difficulties met by the Renter (including for acts of god) and therefore recommend that Renters hold insurance covering cancellations.

If a visitor wishes to cancel a booking it must give Le Val Lachard notice in writing as soon as possible.  Cancellation takes effect on the day we receive the written notification.

If cancellation is made more than 30 days of stay start date, the deposit made will not be refund. If cancellation is made within 30 days of stay start date, 100% of the rental price is due.

If following a booking, the full balance is not paid on time, the Val Lachard shall notify the Visitor. If, after 30 days from the date on which full payment is due, full payment has not been received by the Val Lachard then it may cancel the holiday booking and the above cancellation charges will apply, even if that requires extra payment to be made

2. made by Le Val Lachard

Booking can be cancelled by the Val Lachard in case of acts of god or for any reason outside of Val Lachard reasonable control. The Val Lachard will take reasonable steps to offer a suitable alternative booking. If the Val Lachard is not able to offer such an alternative or the Renter does not accept the alternative offered, the Val Lachard will return to the Renter twice the relevant proportion of the rental price paid by the Renter to the Val Lachard in respect of the Accommodation and will not otherwise be liable for any additional loss caused by such alteration or cancellation.

 

5. Occupancy and maximum numbers of guests

1. Occupation must be limited to the maximum number of persons for the Accommodation stated in the available beds only — no additional camp beds are allowed. The occupation limits are set in line with the Insurance Policy.

2. Maximum capacity allowed in the apartment include adults, children and babies.

3. Such any over-occupancy is considered to be a serious infringement of the Terms and Conditions and can result in an immediate requirement to vacate the premises, with no refund of monies due.

 

6. Pets

No domestic pets can be permitted in Le Val Lachard apartments.

Assistance dogs are permitted in the apartment, however the Renter must notify the Val Lachard on the intended presence of any assistance dogs prior to booking.

 

7. Le Val Lachard Right of Entry

As with any accomodation, there is a need for ongoing and occasionally unforeseen work in Accomodation. The Val Lachard and its contractors may enter the Accomodation at any reasonable time for reasonable cause. This includes the need to undertake inspections and audits necessary to operate the business, the undertaking of unforeseen (internal and external) remedial repairs together with any annual external re-decoration for which access to the inside of the Accomodation may be required. External windows and doors may be opened during this process.

 

8. Visitor Obligations

1. The Renter will be responsible for all payments and for any damage whether caused by the Renter or his or her party. The Renter agrees to make his or her party aware of these Terms and Conditions.

2. The Visitor agrees to keep and leave the Accommodation and its contents in the same state of repair and condition, and in a clean and tidy state as at the start of the booking period.

3. The Visitor must allow the Val Lachard and/or its agents to enter the Accommodation to inspect the state of it, on reasonable notice, except in emergency when immediate access must be granted.

4. The Visitor must not use the Accommodation or allow its use for any dangerous, offensive, noisy, illegal or immoral activities or carry on there any act that may be a nuisance or annoyance to the Val Lachard' s visitors.

5. Noise : The visitor must be respectful at any time but specially between 10pm and 8am.

Television, radios and any other equipment making noise must be kept reasonably quiet, mainly in common and external parts.

5. Smoking is not permitted and the Visitor or any member of his or her party agrees not to smoke inside the Accommodation. Smoking outside is permitted but the French windows and doors must be closed.

6. The use of candles or fireworks by the Visitor or his or her party at the Accommodation is strictly not permitted. Use of barbecues is not permitted at any time unless they are provided at the Accommodation by the Val Lachard.

7. Security information are available on apartments' front doors. Please read beforehand  the procedure to follow in case of fire alarms.

8. Visitor must not leave personal effects in common parts, specially outside. A storage room is available on the premises to secure all sport equipment.

9. Visitors are not allowed to come into the premises with ski shoes or skis which must be kept into the storage room. This is also the case for bicycles or any other sport equipment.

10. Different waste dustbins are at the disposal of the guests

11. Internet Access : the Renter is responsible for the use of Internet Access during his stay.

12. Fireplaces : Three apartments have fireplaces for which you will find free wood logs on premises. Any extra wood used will be invoiced. Fireplaces must be cleaned regularly with the special product supplied. No other cleaning product is to be used.

13. Parking : All apartments have one covered parking space. Please do not leave any personal valuables effects as Le Val Lachard is not responsible for any loss, damaged or stolen effects.

14. Energy and Environment  By making sure that doors and windows are closed, you increase the comfort of all guests. By making sure lights, television and water supplies are off, you help saving energy et protect environment.

9. Damages and Security Charge - Agreed List of contents

1. The Val Lachard recommends that Renters hold personal insurance for accidental damage and personal liability.

2. On arrival at the Accommodation and before you leave, an agreed list of contents will be done. In order to save time the day you leave, would you please put all apartment's contents at the same place than you found them.

3. Should the Visitor find that there is a problem, or cause for complaint, the Visitor should immediately contact the Val Lachard so reasonable steps can be taken immediately.

 

10. Arrival and departure Times

1. The Renter must arrive from 5pm on the first day of the rental period and depart at the latest at 10am on the last day of the holiday period.

2. The Visitor will be issued with a set of keys to the Accommodation on the first day of the holiday period and the Visitor must return them on the last day of the holiday period of the date of departure, if earlier. Failure to do so will incur the cost of a replacement set. It is strictly forbidden to have the keys copied.

 

11. Rural Way of life

Bats and other wildlife may be present. Any disturbance caused to the Renter should be reported immediately and reasonable steps will then be taken to assist the Renter. Bats are a protected species and it is illegal to interfere with them or their habitat.

 

12. Right to Evict

1. The Val Lachard may terminate the Agreement on notice, and in such case the Visitor and his or her party must leave the Accommodation, (without compensation being payable to the Visitor or any member of his or her party) if

a. this is deemed necessary by The Val Lachard where there is a serious breach by the Visitor of the Agreement or the Visitor’s or his or her party’s behaviour endangers the safety of other Visitors or members of staff; or

b. any complaints are made of anti-social, unacceptable behaviour or unreasonable breakages or damage occurs or smoking restrictions are not observed.

 

13. Governing Law

The construction, validity and performance of the Agreement shall be governed by the law of France, and both parties submit to the non-exclusive jurisdiction of the French courts.

14.Mediator

After having contacted the Val Lachard customer service and in the absence of a satisfactory response within 2 months, the customer may refer the matter to the Tourism and Travel Ombudsman, whose contact details and procedures are available on his website: https://www.cm2c.net
